Terms of service

Effective date: August 23, 2026

These Terms of Service (“Terms”) are the contract between you and Nioksstil, meaning the seller identified on your order confirmation, payment receipt, or invoice (the “Seller”). If you do not agree, do not use the site or place an order.

By creating an account, placing an order, or using this website, you agree to these Terms, the Privacy Policy, the Refund Policy, the Shipping Policy, the Terms of Sale shown at checkout, and the Limited Warranty. Those documents are part of this contract.

1. Who we are

Nioksstil is the brand name of the store. Until a separate legal entity is named on your receipt, the contracting party is the Seller named on that receipt. Support contact: support@nioksstil.com.

We may assign this contract to an affiliated company or to a successor that continues the store. We will update the Seller name on new receipts after that happens.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You may not order if you are on a U.S. denied-party list or in a destination we cannot legally serve. LED face masks are intended for adult personal use as described in the user guide. They are not toys and are not for unsupervised use by children.

3. What the product is — and is not

Nioksstil products currently sold on this site are LED facial light-therapy / wellness devices for personal, non-professional use. They are not marketed as medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Product pages, The Science page, and educational content describe light, design, and typical wellness use. They are not medical advice, a clinical protocol, or a promise of a specific biological or cosmetic result. Individual results vary. If you have a medical condition, take photosensitizing medication, are pregnant or nursing, have a history of seizures, skin cancer, eye disease, or are under a physician’s care, consult a qualified clinician before using an LED device.

You agree to read the user guide before first use, to follow session times and eye-safety instructions, and not to stare into LEDs. Misuse can cause skin irritation, eye discomfort, or other injury. You assume the risks of use that remain after you follow the guide, to the extent law allows.

We do not authorize use in clinics, spas, or on paying clients unless a product page expressly says the device is sold for professional use.

4. Accounts, reviews, and acceptable use

You are responsible for account credentials and for activity under your account. Do not use the site to break the law, scrape in a way that harms the service, upload malware, or post unlawful, infringing, or deceptive content.

If you submit a review, photo, or testimonial, you grant Nioksstil a non-exclusive, worldwide, royalty-free license to use that content for store operation and truthful marketing, and you confirm it is your honest experience. We may refuse or remove content that is false, unlawful, or off-topic.

5. Orders, price, and payment

Displayed prices may change until checkout is completed. We may refuse or cancel an order for suspected fraud, allocation limits, pricing or inventory errors, or legal restrictions. If we cancel after payment, we refund the amount we captured for the cancelled items.

An obvious pricing error (for example a flagship mask listed at a few dollars because of a system fault) is not an offer we are required to honor. We will cancel and refund if that happens.

You authorize Shopify and our payment processors to charge the method you select. We do not store full card numbers on our own servers. Failed, reversed, or charged-back payments may result in suspension of fulfillment or of the account.

Title to goods transfers to you on delivery as described in the Shipping Policy, subject to our right to reclaim goods if payment is reversed.

6. Shipping, returns, and warranty

Delivery estimates, risk of loss, international duties, and damaged-on-arrival rules are in the Shipping Policy. Convenience returns (unopened / unused, 30 days) and defect remedies are in the Refund Policy. Manufacturing defects after the convenience window are in the Limited Warranty.

Those documents control the remedy. A social-media comment or a verbal promise that is not confirmed in writing by support@nioksstil.com does not change them.

7. Intellectual property

The Nioksstil name, logos, product design, photos, copy, and site code are owned by us or our licensors. You may not copy them for commercial use without written permission. You may not reverse engineer the device except to the limited extent a statute says we cannot prohibit it.

8. Disclaimer (except the Limited Warranty and non-waivable rights)

Except for the written Limited Warranty and any guarantee that law does not allow us to disclaim, the site and the products are provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent a court will enforce. Some U.S. states do not allow disclaimer of implied warranties; in those states the disclaimer does not apply to the extent prohibited, and implied warranties last only as long as the Limited Warranty or the minimum period the state requires, whichever is longer.

9. Limitation of liability

To the maximum extent a court will enforce, Nioksstil and the Seller are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or substitute goods, arising out of the site, an order, or use of a product.

Our total liability for any claim related to an order is limited to the amount you actually paid us for the product giving rise to the claim, except where this cap is forbidden (including liability for fraud, willful misconduct, or personal injury where state law does not allow a cap).

This section does not limit the Limited Warranty, a statutory right that cannot be limited, or our obligation to refund when this contract or the Refund Policy requires a refund.

10. Indemnity

You will defend and indemnify Nioksstil and the Seller against claims arising from your misuse of a product, your violation of these Terms, or your user content, except to the extent the claim is caused by our failure to supply a product that conforms to the Limited Warranty or by our willful misconduct.

11. Disputes

Contact support@nioksstil.com first and allow 30 days for a good-faith written attempt to resolve the dispute.

These Terms are governed by the laws of the United States and of the U.S. state of the Seller’s then-current principal place of business (as stated on your order confirmation or invoice), without regard to conflict-of-law rules that would apply a different state’s law, except that U.S. federal law applies to issues it governs (including arbitration enforceability if a later version adds arbitration, and any federal consumer or mail-order rule).

If we have not yet listed a state on your receipt, exclusive venue for court actions that may be brought is the state and federal courts located in the U.S. state from which your order was shipped, and you consent to those courts. Either party may still seek temporary injunctive relief in any court of competent jurisdiction to protect intellectual property or to stop unlawful use of the site.

We do not currently require arbitration or a class-action waiver. If a future version adds those clauses, they will apply only to orders placed after the new Terms are posted, and only to the extent enforceable.

If you are a consumer and mandatory law of your residence requires a different venue, governing law, or procedure, that mandatory law controls for your claim.

12. Electronic communications

You agree to receive order, shipping, and legal notices electronically at the email on the order or account. It is your job to keep that email working and to read our messages.

13. Changes, entire agreement, severability

We may update these Terms by posting a new version. The posted version on the order date applies to that order. If a clause is held unenforceable, the rest remains in force. These Terms plus the policies named above are the entire agreement for site use and purchases, and they supersede prior informal statements.

A failure to enforce a clause is not a waiver. You may not assign your order without our consent; we may assign ours as stated in Section 1.
